The "!ndigoIdeas" Facebook Application ("The Application") is operated by Indigo Books & Music Inc. ("Indigo"). By accessing, browsing and/or using the Application, you agree to these terms and conditions ("Terms and Conditions"), which are not exhaustive and Indigo reserves the right to modify them at any time, effective upon posting. The Application is in no way sponsored, endorsed or administered by, or associated with, Facebook.
The Application is dedicated to the discussion of ideas and improvements related to Indigo’s products and services, but not any topic or issue related to Indigo. The Application is not the appropriate channel to seek technical support or inquire about an online order, for example. Indigo provides a number of other channels, including online channels, for customers to inquire about Indigo’s products and services, or seek resolution of specific issues – please make sure to use the appropriate channels that suit your needs.
The goal of the Application is to encourage the sharing and discussion of individual ideas, comments and solutions, and is not to be used as a means to pitch commercial interests, disseminate “chain letters”, discuss political opinions, sensitive financial matters and topics unrelated to Indigo’s business or industry. Users are required to follow basic legal restrictions – like with any website – for example, not infringe on any patent, copyright, trade mark or share any confidential information, as discussed in more detail below.
Users are expected to engage in civil and constructive dialogue. Ideas must be in good taste and in keeping with Indigo’s brand image. Anything that is deemed solely by Indigo to be inappropriate, inaccurate, profane, defamatory, illegal, violating the rights of any third party, etc. will be removed. Spam will also not be tolerated.
The Application will be moderated by Indigo and users, who are encouraged to flag inappropriate material and notify Indigo for removal. Not all the ideas posted will be responded to or commented on by Indigo. The Application is intended to be a forum for ideas, and not a Q & A with Indigo or for responses to specific customer questions. Users are encouraged to provide their input and responses. Indigo will consider the most popular ideas, as selected by users, and review the suggestions for business potential and viability. There is no obligation on the part of Indigo to consider and comment on each submission.
You are prohibited from transmitting any "sensitive" personally identifiable information through the Application, which may include, but is not limited to, any information about yourself or another person that may relate to health or medical conditions, social security numbers or other identifiers, credit card, bank account or other financial information, sex life, political opinions, criminal charges or convictions, religious or philosophical beliefs, racial or ethnic origin, or other sensitive matters.

You grant Indigo and its designees a perpetual, irrevocable, non-exclusive, fully-paid up and royalty-free license to publish your remarks, suggestions, slogans, graphics, photographs or other information communicated to Indigo through the Application (the "Ideas") without restrictions of any kind and without any payment or consideration of any kind, or permission or notification, to you or any third party. The license shall include, without limitation, the following rights:
You waive all your moral rights in any Ideas expressed without notice or compensation.
By making a Submission to the Application, you hereby represent and warrant that:
By submitting Ideas, you acknowledge and agree that Indigo and its designees may create their own or obtain many submissions that may be similar or identical to the Ideas you submit through the Application. You hereby waive any and all claims you may have had, may have and/or may have in the future, that the Indigo’s accepted, reviewed and/or used by Indigo and its designees may be similar to your Ideas.
Indigo may release information concerning your use of the Application (including submissions, registration information, and network records), when Indigo believes release is appropriate to comply with the law; to enforce these Terms and Conditions, to protect Indigo’s rights or property, or to protect users from fraudulent, abusive, or unlawful use of the Application, or if Indigo reasonably believes that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records.
